1. Acceptance of Terms

By accessing or using Fotoyan ("App", "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Eligibility

You must be at least 13 years old or the minimum legal age in your jurisdiction.

3. Description of Services

Fotoyan provides:

• AI-based image generation from text prompts
• Photo editing and enhancement tools
• Access to multiple AI models via third-party providers

We reserve the right to modify or discontinue features at any time.

4. AI-Generated Content & Ownership

4.1 User Ownership

You retain ownership of:

• Images you upload
• Prompts you input

For AI-generated outputs:

You are granted a perpetual, worldwide, royalty-free, non-exclusive license to use, modify, and distribute generated images.

4.2 Platform Rights

You grant Fotoyan a limited, non-exclusive license to:

• Process your content to provide services
• Improve system performance and safety (unless you opt-out, where applicable)

4.3 Third-Party AI Providers

AI outputs are generated using third-party services such as:

• OpenAI (ChatGPT / DALL·E)
• Google (Gemini)
• xAI (Grok)

Your use is also subject to their respective terms.

5. AI Limitations & Disclaimer

You acknowledge that AI-generated content:

• May be inaccurate, misleading, or incomplete
• May unintentionally resemble existing copyrighted works
• Should not be relied upon for legal, medical, or professional advice

All outputs are provided "as is" without warranties of any kind.

6. Prohibited Use

You agree NOT to use Fotoyan to:

• Generate illegal, harmful, defamatory, or abusive content
• Create NSFW, explicit, or violent material (where restricted)
• Infringe copyrights, trademarks, or other rights
• Impersonate individuals or create deepfakes without consent
• Attempt to reverse engineer or exploit the system

We reserve the right to remove content and suspend accounts.

7. Third-Party Services

We are not responsible for:

• Downtime or failures of AI providers
• Content generated by third-party APIs

8. Termination

We may suspend or terminate your access if:

• You violate these Terms
• You misuse the platform

9. Limitation of Liability

To the maximum extent permitted by law:

• Fotoyan is not liable for indirect, incidental, or consequential damages
• Liability is limited to the amount paid by you (if any)

10. Indemnification

You agree to indemnify and hold harmless Fotoyan from claims arising from your content and your misuse of the App.

11. Changes to Terms

We may update these Terms periodically. Continued use constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India, with jurisdiction in Gujarat.
